Terms of use
Last updated: October 30, 2026
§ 1 Operator and Scope
These Terms of Use govern access to and use of SEODA.de, including its analysis, valuation, membership and marketplace functions.
The platform is operated by:
Fahrettin Tireki
SEODA.de – Sole Proprietorship
Bismarckstraße 26
73054 Eislingen
Germany
Email: info@seoda.de
Website: https://seoda.deThese Terms apply to visitors, registered users, sellers and buyers who use SEODA services.
Paid services are additionally subject to the General Terms and Conditions (GTC) and the applicable service descriptions. The Privacy Policy explains how personal data is processed.
Mandatory statutory rights, particularly consumer and data protection rights, remain unaffected.
§ 2 Purpose and Functions of the Platform
SEODA is a platform for the technical analysis, valuation and, where available, facilitation of transactions involving domains, websites and digital projects.
Services offered or made available following activation may include:
domain and SEO analyses;
technical performance and security assessments;
automated website valuations;
paid advanced reports;
user accounts and memberships;
sales listings for domains and digital projects;
verification of financial information;
paid promotional placement of listings;
subscriptions and other expressly offered services.
Features that have not been activated or have only been announced do not create an entitlement to use them.
The characteristics of paid services are determined by their descriptions and the applicable contractual agreements.
§ 3 Analysis of Publicly Accessible Domains
Visitors may generally request an analysis of any publicly accessible domain using SEODA's designated analysis function. Proof of ownership is not required for ordinary passive analysis of publicly available information.
Analysing a third-party domain does not mean that the visitor owns that domain or that SEODA is affiliated with its operator.
Analyses must be carried out only through the designated functions and within permitted technical limits.
Using SEODA does not authorise unauthorised access to third-party systems, circumvention of access restrictions or active security testing without the necessary permission.
SEODA may limit or reject requests where security risks, improper use or significant technical loads are identified.
Domains whose analysis or publication would violate applicable law may be excluded from processing or public display.
§ 4 Public Analysis Results
Analysis results may be published on publicly accessible result pages, domain profiles or individual URLs on SEODA.
Public results may include domain names, technical measurements, SEO scores, loading times, security indicators and non-binding valuation estimates.
Publication of an analysis does not constitute a recommendation, certification or confirmation that the analysed website is lawful.
Results may be incomplete or outdated due to technical limitations, changes over time or information supplied by external providers.
For security reasons, SEODA may exclude sensitive technical details from public reports where publication could facilitate misuse.
Affected individuals may request correction of inaccurate information or review of published results by contacting info@seoda.de.
Statutory rights to rectification, erasure, restriction of processing and objection remain unaffected.
SEODA may update public reports, restrict their visibility or remove them where a lawful or contractual basis permits such action.
§ 5 Registration and User Accounts
Public free analyses may be used without registration where this option is offered.
Certain advanced functions require a user account.
Registered users must provide accurate and current information and protect their login credentials against unauthorised access.
Sharing an account for abusive purposes, using stolen credentials and impersonating other individuals or organisations are prohibited.
Users must promptly report suspected unauthorised access to their accounts.
Multiple accounts must not be used to circumvent suspensions, usage limits, security controls or contractual restrictions.
SEODA may implement appropriate security measures where there are reasonable grounds to suspect misuse.
§ 6 Age Requirements
Publicly accessible analysis functions may generally be used by people of any age, provided the specific use is lawful.
Users must be at least 18 years old to participate in the SEODA marketplace as buyers or sellers.
Individuals under 18 may not publish marketplace listings, submit purchase offers or conclude marketplace transactions in their own names.
SEODA may request appropriate evidence of eligibility where necessary and permitted under data protection law.
Statutory rules on legal capacity apply to other paid services.
§ 7 Marketplace Participation
Both private individuals and businesses may participate in the SEODA marketplace, subject to applicable legal and contractual requirements.
Sellers must accurately state whether they are acting privately or in the course of business.
Business sellers must provide the company and contact information legally required for their offers.
Only domains, websites, digital projects and other expressly permitted assets that can lawfully be transferred may be offered.
A seller must own the offered project or have valid authority to sell it.
Publishing a listing does not automatically create a purchase agreement with SEODA. Transactions between independent users are generally concluded directly between the buyer and the seller.
SEODA may request additional information or evidence where necessary to comply with the law or prevent abuse.
§ 8 Requirements for Sales Listings
Sales listings must be accurate, understandable and sufficiently complete regarding their material characteristics.
In particular, information concerning revenue, profit, visitor numbers, operating costs, ownership, licences and transferable rights must not knowingly be false or misleading.
Estimated, unverified or projected figures must be clearly identified as such.
A SEODA verification badge may only be used if the corresponding verification has actually been completed and remains valid for the relevant listing.
Sellers must not use forged documents, manipulated statistics or misleading evidence of ownership.
Publishing personal information belonging to third parties without a lawful basis is prohibited.
Sellers must disclose material legal or technical obstacles to transferring the project.
If information is insufficient or contradictory, SEODA may request corrections, additional evidence or temporary deactivation of the listing.
§ 9 Paid Memberships and Additional Services
Paid services may include advanced analyses, valuation reports, verification services, promoted listings and subscriptions.
Prices, duration, usage limits and service features are determined by the binding order summary and the General Terms and Conditions.
Payments may be processed through Stripe or PayPal.
A paid plan grants access only to its designated functions.
Premium or Pro membership does not entitle a user to preferential treatment regarding the enforcement of security rules or legal requirements.
Statutory rights of withdrawal, termination, reimbursement and remedies for non-conforming services remain unaffected.
§ 10 Advertising and Promoted Listings
Listings receiving paid promotional placement will be identified accordingly.
Promoted placement does not guarantee any particular number of visitors, enquiries or completed sales.
Payment for promotion does not mean that SEODA has verified the listing's financial information or legality.
Paid and promoted listings remain subject to all rules governing use and content moderation.
The main parameters governing marketplace sorting and ranking will be explained where required by law.
§ 11 Prohibition of Illegal Content and Listings
All content, listings, offers and uses of SEODA that violate applicable law are prohibited. This rule applies without exception to free users, paying members and Premium or Pro customers.
Prohibited content and activities include, in particular:
fraudulent or fabricated sales listings;
phishing websites and offers involving credential theft;
unlawful malware services and services used to conduct cyberattacks;
offers involving stolen data, accounts or digital assets;
criminal content, including unlawful incitement to hatred or crime;
child sexual abuse material and other content prohibited by law;
offers that unlawfully infringe copyright, trademarks or personality rights;
unlawful gambling, fraud schemes or other prohibited business activities;
unauthorised publication of confidential information or personal data;
other content, products or services whose offering or distribution is unlawful.
The prohibition also applies to sales listings linking to unlawful external websites or illegal business models.
Where SEODA determines, following an appropriate assessment, that content or a listing published on the platform is illegal, it will remove the content or disable access to it to the extent required by law and technically possible.
Clearly unlawful or particularly serious content may require immediate temporary restriction pending further review.
A paid subscription, Pro status, verification badge or previously purchased promotional placement does not protect illegal content from removal.
SEODA may also remove or restrict publicly displayed analysis results relating to unlawful offerings where this is lawful or necessary following an appropriate review.
Removing an entry from SEODA does not mean that SEODA can technically delete an external website or domain operated by a third party.
Statutory refund rights and other existing rights of affected parties remain unaffected by restrictions.
§ 12 Prohibited Technical Activities
Using SEODA to carry out or prepare unlawful attacks is prohibited.
In particular, users must not:
gain unauthorised access to accounts, systems or data;
attack the availability of SEODA or third-party systems;
perform mass automated requests outside expressly permitted interfaces or usage limits;
circumvent access restrictions, security measures or API limits;
distribute malicious software;
manipulate measurements or analysis results;
misrepresent identity, domain ownership or permissions;
exploit security vulnerabilities outside an expressly authorised security assessment.
SEODA may use reasonable technical measures to prevent such activities.
Access to a public domain analysis function does not authorise active attacks or unauthorised penetration testing.
§ 13 Intellectual Property and Usage Rights
Rights in SEODA's software, design, protected databases, text and other proprietary content remain with their respective rights holders.
Using the platform does not transfer ownership or intellectual property rights.
Users must possess all necessary rights to the text, images, logos and other material they publish.
Users grant SEODA the non-exclusive rights necessary to store, technically process, display and promote their published listings in accordance with the applicable contract.
These rights are limited to the necessary scope and the period of lawful publication or otherwise lawful retention.
Unauthorised reuse, copying or commercial exploitation of protected content is prohibited.
§ 14 Reporting Illegal Content
Users, rights holders and other affected individuals may report potentially illegal content or sales listings.
Reports may be sent to:
A report should preferably include:
the exact URL or identification of the content;
an understandable explanation of the suspected legal violation;
appropriate supporting evidence, where available;
the reporting person's contact details where legally required;
a statement confirming that the information is accurate and complete to the best of their knowledge.
Statutory exceptions to the provision of personal contact details remain unaffected.
SEODA reviews sufficiently specific reports in a timely, diligent, objective manner, taking the rights of all involved parties into account.
The review may consider the nature of the content, the facts presented, potential violations and the consequences of restricting access.
Where required by law, reporting and affected persons receive acknowledgements or notifications of decisions.
Knowingly false or abusive reports are prohibited.
§ 15 Content Moderation and Review
SEODA may review content following reports or based on its own findings within the limits of applicable law.
Moderation may involve manual review and, where actually implemented, technical or automated detection methods.
Available measures may include:
requests for correction;
reduced visibility;
temporary deactivation;
removal of a listing or content;
restriction of individual functions;
temporary or permanent account suspension.
Measures must be justified and proportionate to the circumstances of the individual case.
Serious legal violations or immediate security risks may require prompt action.
Where required by law, affected users will receive reasons for the decision and information about available remedies.
In enforcing these rules, SEODA takes legally protected rights and interests into account, including freedom of expression and information.
These Terms do not establish a general obligation to monitor all user content without specific grounds.
§ 16 Appeals Against Moderation Decisions
Users may challenge removals, suspensions or other moderation measures that they consider unjustified.
To request a review, users may email info@seoda.de, identifying the affected content and explaining their objection.
SEODA will assess the circumstances presented and correct erroneous decisions where appropriate.
Where a statutory internal complaint-handling system, out-of-court dispute settlement procedure or other remedy applies, the relevant options will be provided in accordance with applicable legal requirements.
The right to approach competent authorities or courts remains unaffected.
§ 17 Account Suspension and Termination
Serious or repeated violations of these Terms may result in appropriate restrictions or account suspension.
Particularly serious legal violations may justify or require immediate suspension.
For less serious violations, SEODA will consider advance notice or an opportunity to correct the issue where appropriate.
An existing Premium or Pro agreement does not prevent a suspension required by law.
The treatment of amounts already paid is governed by the contractual arrangements and applicable law. Mandatory refund rights are not excluded.
Account suspension does not authorise processing personal data contrary to statutory retention or deletion obligations.
§ 18 Responsibility for Analyses and Business Decisions
SEODA provides technical measurements, statistical indicators and, where applicable, model-based valuations.
Results do not guarantee commercial success, legal compliance or technical security.
Valuation estimates do not replace individual financial due diligence or legal advice.
Before purchasing a digital project, users should independently examine ownership rights, revenues, expenses, usage statistics, technical dependencies and transferable contracts.
Statutory rights concerning defective or non-conforming SEODA services remain unaffected.
§ 19 Data Protection
Personal data is processed in accordance with applicable data protection law.
SEODA's separate Privacy Policy describes the categories of data, purposes, legal bases, recipients, retention practices and data subject rights.
Users must not publish third-party personal data through the platform without a lawful basis.
Public domain analysis results may only be displayed in accordance with applicable data protection and other legal requirements.
§ 20 Changes and Availability
SEODA may develop the platform and adapt functions within the limits of applicable law and existing contractual obligations.
Changes to existing paid contracts are subject to statutory requirements and any necessary consent procedures.
Publishing revised Terms alone does not validly amend existing contracts where a separate legal basis or consent is required.
SEODA endeavours to maintain reliable availability without excluding statutory or contractually guaranteed rights.
Necessary maintenance, security measures and technical disruptions may temporarily restrict availability.
§ 21 Final Provisions
German law applies to the extent legally permissible.
Mandatory consumer protection provisions of the country where a consumer habitually resides remain unaffected as prescribed by applicable law.
Statutory rules on jurisdiction apply.
If individual provisions become invalid, the remaining provisions continue to apply to the extent permitted by law. Invalid provisions are replaced by the applicable statutory rules.
